These Advertising Terms & Conditions (“Terms”) govern the purchase and placement of advertisements and business listings on Find Boat Services (accessible at midwestboatingservices.com, the “Site”), owned and operated by Rock Lincoln, LLC dba Find Boat Services (“Company,” “we,” “us”). By claiming, creating, or maintaining a listing on the Site, Merchant agrees to be bound by these Terms.
1. Listing Services
Find Boat Services agrees to publish Merchant’s business information in the directory according to the tier selected by Merchant at the time of registration. Current listing tiers are Basic (Free), Standard, and Premium. Company reserves the right to determine the final layout, design, and placement of all listings and to modify tier features with reasonable advance notice to Merchants.
Listing Approval: All listing claims are subject to verification and approval by Company. Company reserves the right to deny or delay approval of any listing claim pending verification of business ownership or legitimacy. Submission of a claim does not guarantee approval or publication.
2. Content Rights & Accuracy
Merchant grants Company a non-exclusive, worldwide, royalty-free license to use Merchant’s business name, logo, trademarks, and submitted photos for the purpose of creating, displaying, and promoting the listing on the Site and in related marketing materials.
Merchant Responsibility: Merchant is solely responsible for ensuring that all listing information — including business name, address, phone number, hours of operation, services, and photos — is accurate and current. Company is not responsible for inaccuracies resulting from outdated or incorrect information submitted by Merchant.
Company Right to Edit: To maintain Find Boat Services’ professional standards, Company reserves the right to edit listing descriptions for grammar, clarity, and formatting without altering the factual content or meaning of the listing.
Prohibited Content: Company reserves the right to reject or remove any listing that contains misleading, illegal, defamatory, or offensive material, or any content that violates the rights of a third party.
Locked Fields: Business name and primary address, once verified and approved, may not be modified without submitting a change request to Company for re-verification. Company reserves the right to require documentation to verify requested changes.
3. Fees, Billing, and Cancellation
Subscription: All paid listings operate on a subscription basis. By selecting a paid tier, Merchant authorizes Company to charge the selected payment method on a recurring basis — monthly or annually — according to the selected plan and current published rates.
Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle to ensure uninterrupted service. Merchant will receive a renewal reminder no less than 7 days before the renewal date.
Cancellation Policy: Merchants may cancel their subscription at any time. To avoid being charged for the next billing cycle, cancellation must be processed at least 48 hours before the scheduled renewal date.
How to Cancel: Cancellations may be processed directly via the Merchant Dashboard under “Billing” or “My Account.” Alternatively, a written cancellation request may be submitted to aaron@midwestboatingservices.com, provided it is received within the required notice period. Cancellation requests received after the notice period will take effect at the following renewal date.
No Refunds: All fees paid are non-refundable. If Merchant cancels a paid subscription mid-term, paid listing features will remain active until the end of the current billing cycle. No pro-rated refunds will be issued for unused time within a paid term.
Downgrade on Cancellation: Upon the expiration of a paid term following cancellation, the listing will automatically revert to the Basic (Free) tier. Listings will not be removed solely as a result of subscription cancellation. Company reserves the right to remove a listing only in cases of Terms violation as described in Section 6.
Price Changes: Company reserves the right to modify subscription pricing at any time. Existing Merchants will receive no less than 30 days written notice before any price increase takes effect on their account.
4. Founding Member Bonus
The first 40 Merchants who subscribe to the Premium tier may be eligible for a complimentary Captain’s Chair: Pro Spotlight — a professionally written feature article published about their business on the Site. This offer is subject to availability and is provided as a promotional benefit at Company’s discretion. The Captain’s Chair: Pro Spotlight constitutes a value-added benefit and does not form part of the core Premium subscription agreement. Company makes no guarantee regarding the timing of publication. This promotional offer applies to the first 40 qualifying Premium subscribers only and is not available to subsequent subscribers unless otherwise announced by Company.
The Captain’s Chair: Pro Spotlight is available exclusively to Merchants who subscribe to the Annual Premium tier. Merchants on a monthly Premium subscription are not eligible for this promotional benefit. Additionally, the Captain’s Chair: Pro Spotlight article may be removed from the Site at Company’s discretion if the qualifying Annual Premium subscription lapses, is cancelled, or is downgraded.
5. No Guarantee of Results
Find Boat Services provides an advertising and directory platform designed to increase Merchant visibility among boaters in the Midwest. Company does not guarantee any specific number of leads, calls, inquiries, clicks, or increased revenue as a result of listing placement. Merchant agrees that the success or failure of Merchant’s business operations is solely the responsibility of Merchant and is not the responsibility of Company.
6. Limitation of Liability
In no event shall Rock Lincoln, LLC, its officers, employees, or agents be liable for any errors or omissions in a listing, technical outages, interruptions of service, loss of business data, or any indirect, incidental, or consequential damages arising from Merchant’s use of the Site or listing services. Company’s total cumulative liability to Merchant for any claim arising under these Terms shall not exceed the total amount paid by Merchant to Company during the six (6) months immediately preceding the date the claim arises.
7. Termination by Company
Company reserves the right to suspend or permanently terminate any listing at its sole discretion if Merchant violates any provision of these Terms, provides false or misleading business information, engages in conduct that damages the reputation or integrity of Find Boat Services, or fails to maintain the professional standards consistent with the Find Boat Services mission. In cases of termination for cause, no refund of paid fees will be issued.
8. Review & Feedback Policy
Neutral Platform: Merchant acknowledges that Find Boat Services operates as a neutral platform for user-generated content. Company does not author, edit, or endorse any user review and is not liable for the content of reviews posted by third parties.
Review Integrity: Company will not remove, suppress, or alter a review solely because it is negative or because Merchant disagrees with the reviewer’s opinion. Merchant acknowledges that negative reviews are a normal part of operating a publicly listed business.
Removal Criteria: Company will consider removing a review only if it is demonstrated to be:
- Fraudulent or spam — posted by someone with no legitimate service interaction with Merchant
- Containing profanity, hate speech, personal threats, or content that violates applicable law
- Clearly posted to the wrong business listing in error
Merchant Response: Merchants are encouraged to respond professionally to all reviews, including negative ones. Find Boat Services provides a Merchant Response tool allowing public clarification or resolution of disputes. Professional responses to negative reviews are among the most effective ways to demonstrate business integrity to prospective customers.
Review Moderation: All reviews are subject to Company’s moderation at its discretion prior to or following publication. Company’s decision regarding review removal or retention is final.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to its conflict of law provisions. Merchant agrees that any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Illinois.
10. Dispute Resolution
In the event of a dispute arising out of or relating to these Terms, the parties agree to first attempt resolution through good faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, the parties agree to submit the dispute to binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules. The arbitration shall take place in Illinois. The decision of the arbitrator shall be final and binding on both parties.
11. Modifications to Terms
Company reserves the right to modify these Terms at any time. Merchants will be notified of material changes via email to the address on file no less than 14 days before the changes take effect. Continued use of the listing service after the effective date of any modification constitutes acceptance of the revised Terms.
12. Entire Agreement
These Terms, together with Company’s Privacy Policy, General Terms of Service, and Cancellation Policy, constitute the entire agreement between Company and Merchant with respect to the subject matter herein and supersede all prior agreements, representations, or understandings.
